This thesis examines the evolution of the relationship between law and technology in the determination of paternity in Italy, from the nineteenth century to the present day, reconstructing the progressive transformation of evidentiary models in light of developments in medical and biological sciences. Starting from the prohibition of investigations into natural paternity established by the Civil Code of 1865, the study analyses the gradual shift away from a predominantly moral and testimonial conception of proof, highlighting the growing role of scientific knowledge in civil proceedings. Particular attention is devoted to the transition from early criteria based on blood groups and serology to modern DNA analysis techniques. The research shows how the introduction of forensic genetics has affected the relationship between judge and expert, as well as the balance between scientific truth and legal truth, with significant implications for the burden of proof and the protection of personal identity.

La tesi analizza l’evoluzione del rapporto tra diritto e tecnologia nell’accertamento della paternità in Italia, dall’Ottocento ai giorni nostri, ricostruendo il progressivo mutamento dei modelli probatori alla luce dello sviluppo delle scienze mediche e biologiche. A partire dal divieto di indagini sulla paternità naturale previsto dal Codice civile del 1865, il lavoro esamina il superamento di una concezione prevalentemente morale e testimoniale della prova, evidenziando il ruolo crescente del sapere scientifico nel processo civile. Particolare attenzione è dedicata al passaggio dai criteri basati sui gruppi sanguigni e sulla sierologia alle moderne tecniche di analisi del DNA. La ricerca mette in luce come l’ingresso della genetica forense abbia inciso sul rapporto tra giudice ed esperto e sul bilanciamento tra verità scientifica e verità giuridica, con rilevanti ricadute in tema di onere della prova e tutela dell’identità personale.
