This thesis analyzes the role of antitrust authorities in digital markets, with particular attention to the figure of so-called gatekeepers and the effectiveness of sanctions against them. In recent years, the development of digital platforms has led to a high concentration of economic power, making a more active intervention by competition authorities necessary. However, the application of traditional antitrust sanctions has shown some limitations, especially in terms of deterrence and speed of intervention. Starting from these premises, the thesis first focuses on the definition of the concept of gatekeeper and on the evolution of the European regulatory framework, in particular with the introduction of the Digital Markets Act. It then analyzes some significant cases involving major digital platforms, in order to highlight how antitrust authorities have intervened. Finally, the thesis examines the effectiveness of the sanctions imposed and their limits, aiming to highlight the possible developments of competition law in digital markets and the shift towards new forms of regulation.
La presente tesi analizza il ruolo delle autorità antitrust nei mercati digitali, con particolare attenzione alla figura dei cosiddetti gatekeeper e all’efficacia delle sanzioni nei loro confronti. Negli ultimi anni, lo sviluppo delle piattaforme digitali ha portato alla formazione di posizioni di forte concentrazione del potere economico, che hanno reso necessario un intervento sempre più attivo delle autorità di concorrenza. Tuttavia, l’applicazione delle tradizionali sanzioni antitrust ha mostrato alcuni limiti, soprattutto in termini di capacità deterrente e di rapidità di intervento. A partire da questi presupposti, il lavoro si concentra inizialmente sulla definizione del concetto di gatekeeper e sull’evoluzione del quadro normativo europeo, in particolare con l’introduzione del Digital Markets Act. Successivamente vengono analizzati alcuni casi significativi che hanno coinvolto le principali piattaforme digitali, al fine di evidenziare le modalità di intervento delle autorità antitrust. Infine, la tesi si sofferma sull’efficacia delle sanzioni applicate e sui loro limiti, cercando di mettere in luce le possibili evoluzioni del diritto della concorrenza nei mercati digitali e il passaggio verso nuove forme di regolazione
