This thesis examines cybersecurity as a fundamental component of risk management in modern organizations, analyzing the main models and frameworks adopted in this field, with particular focus on the NIST framework and the ISO/IEC 27001 and 27005 standards. It explores the European regulatory framework on cybersecurity, highlighting the obligations introduced by the NIS2 Directive. Special attention is devoted to digital evidence within criminal proceedings, addressing the technical and legal aspects of its acquisition, preservation, and use. Finally, the thesis compares preventive cybersecurity measures with investigative needs, identifying critical issues and future perspectives through the analysis of a real case study observed during an internship.
La tesi analizza la sicurezza informatica come elemento centrale della gestione del rischio nelle organizzazioni moderne, esaminandone i principali modelli e framework, con particolare attenzione al NIST e agli standard ISO/IEC 27001 e 27005. Viene approfondito il quadro normativo europeo in materia di cybersecurity, soffermandosi sugli obblighi introdotti dalla Direttiva NIS2. Un’attenzione specifica è riservata al ruolo delle prove digitali nel processo penale e alle implicazioni giuridiche e tecniche della loro acquisizione e conservazione. Infine, il lavoro mette a confronto le esigenze di sicurezza preventiva e quelle investigative, evidenziando criticità e prospettive future anche attraverso l’analisi di un caso di studio reale osservato durante il tirocinio.
