This thesis reconstructs a case of sexual violence that occurred in the Vicenza area under Habsburg rule, within the framework of the Kingdom of Lombardy–Venetia. The proceedings, initiated in 1836 and lasting for approximately one year until the final verdict, involved a single defendant, Gio Batta Laverda, who was charged with the completed rape of Elisabetta Bellinaso and the attempted rape of Maddalena Vaccaro, both residents of the community of San Giorgio di Perlena. Laverda was ultimately convicted and sentenced to hard imprisonment. The primary sources for this study are the records of the Austrian criminal court, preserved at the State Archives of Vicenza, particularly the witness testimonies and trial proceedings. The thesis adopts a microhistorical approach, focusing on a single archival case while broadening the scale of analysis to situate it within the Italian peninsula during the first half of the nineteenth century. Particular attention is devoted to the themes of sexuality and honour in pre-unification Italian society. The study pursues a twofold objective: on the one hand, it reconstructs the legal categories through which the Austrian judicial system defined and prosecuted sexual violence, thereby contributing to the history of criminal justice and criminal law; on the other, it draws on witness testimonies to recover the community's mentalities and social norms, offering a perspective grounded in the cultural history of sexuality and honour.
La tesi ricostruisce un caso di violenza sessuale verificatosi nel Vicentino sotto la dominazione asburgica, nel quadro del Regno Lombardo-Veneto. Il procedimento, avviato nel 1836 e protrattosi per un anno fino alla sentenza, vide come unico imputato Gio Batta Laverda, accusato di violenza carnale consumata ai danni di Elisabetta Bellinaso e di tentata violazione nei confronti di Maddalena Vaccaro, entrambe residenti nella comunità di San Giorgio di Perlena. Laverda fu infine condannato al carcere duro. Le fonti principali sono gli atti del tribunale penale austriaco, conservati presso l'Archivio di Stato di Vicenza, in particolare le deposizioni testimoniali e gli atti di dibattimento. Il lavoro adotta una prospettiva microstorica, incentrata sul singolo caso di archivio, e propone un salto di scala verso la penisola italiana nella prima metà del XIX secolo. Pone attenzione ai temi della sessualità e dell'onore nella cultura pre-unitaria. L'analisi persegue un duplice obiettivo: da un lato, ricostruire le categorie giuridiche con cui la giustizia austriaca qualificava la violenza sessuale contribuendo alla storia dei processi e del diritto penale; dall'altro, ricavare dalle deposizioni la mentalità e i codici sociali della comunità, in una prospettiva di storia culturale della sessualità e dell'onore.
