This thesis offers a comparative analysis of Regulation (EU) 2024/1689 on artificial intelligence (AI Act) and the Council of Europe Framework Convention on Artificial Intelligence, Human Rights, Democracy and the Rule of Law (CETS No. 225), currently the two leading supranational legal instruments governing AI. While both share the goal of fostering trustworthy AI that respects fundamental rights, they follow markedly different regulatory logics: the AI Act adopts a binding, risk-based approach backed by a sanctioning system but confined to the EU legal space, whereas the Convention rests on a principles-based framework open to non-EU states, relying on more flexible cooperation and monitoring mechanisms for its effectiveness. The work first reconstructs the genesis, structure and governance mechanisms of both instruments, paying particular attention to their current state of implementation and ratification. It then undertakes a systematic comparison covering definitions, risk classification, obligations of the actors involved, and enforcement, before examining the areas of complementarity and potential friction between the two regimes, with specific focus on their impact on the Italian legal system. The thesis concludes with a critical reflection on the evolving prospects of the European and international regulatory framework for artificial intelligence.
