This thesis examines the constitutional implications of integrating algorithmic systems into judicial decision-making, using the FERMES model (Forecasting and Evaluation of Resources Management for the Efficiency of the judicial System) as a case study. Developed within the framework of Italy's National Recovery and Resilience Plan, FERMES aims to enhance the efficiency of judicial offices through predictive analytics. The first chapter reconstructs the theoretical framework of predictive justice, distinguishing between decision-support and decision-substitution models, and analyses the main algorithmic systems deployed in comparative legal experiences, with particular attention to constitutional risks. The second chapter examines the technical and institutional architecture of FERMES, assessing its compatibility with the constitutional principles of judicial independence, due process, and algorithmic transparency, as well as with the regulatory framework established by the European AI Act. The third chapter develops a critical analysis of the structural transformations that algorithmic logic produces within the judicial function: the standardisation of legal reasoning, the compression of adversarial proceedings, the erosion of the judge's interpretative role, and the emergence of a de facto normativity removed from democratic oversight. The thesis concludes that the constitutional compatibility of algorithmic systems in adjudication cannot be resolved through technical means alone, but requires normative choices that preserve the fundamental guarantees of the judicial function.

La presente tesi esamina le implicazioni costituzionali dell'integrazione dei sistemi algoritmici nella giurisdizione, assumendo come caso di studio il modello FERMES (Forecasting and Evaluation of Resources Management for the Efficiency of the judicial System), sviluppato nell'ambito del Piano Nazionale di Ripresa e Resilienza per migliorare l'efficienza degli uffici giudiziari italiani. Il primo capitolo ricostruisce il quadro teorico della giustizia predittiva, distinguendo i modelli di supporto da quelli di sostituzione della decisione giudiziaria, e analizza i principali sistemi algoritmici in uso nelle esperienze comparate, con particolare attenzione ai profili di rischio costituzionale. Il secondo capitolo esamina l'architettura tecnica e istituzionale di FERMES, valutandone la compatibilità con i principi costituzionali di indipendenza del giudice, giusto processo e trasparenza algoritmica, nonché con il quadro normativo dell'AI Act europeo. Il terzo capitolo sviluppa un'analisi critica delle trasformazioni strutturali che la logica algoritmica produce sulla giurisdizione: la standardizzazione del ragionamento giuridico, la compressione del contraddittorio, l'erosione della funzione interpretativa del giudice e la produzione di una normatività di fatto sottratta al controllo democratico. La tesi conclude che la compatibilità costituzionale dei sistemi algoritmici nella giurisdizione non è risolvibile sul piano tecnico, ma richiede scelte normative che preservino le garanzie fondamentali della funzione giurisdizionale.

Abstract

La presente tesi esamina le implicazioni costituzionali dell'integrazione dei sistemi algoritmici nella giurisdizione, assumendo come caso di studio il modello FERMES (Forecasting and Evaluation of Resources Management for the Efficiency of the judicial System), sviluppato nell'ambito del Piano Nazionale di Ripresa e Resilienza per migliorare l'efficienza degli uffici giudiziari italiani. Il primo capitolo ricostruisce il quadro teorico della giustizia predittiva, distinguendo i modelli di supporto da quelli di sostituzione della decisione giudiziaria, e analizza i principali sistemi algoritmici in uso nelle esperienze comparate, con particolare attenzione ai profili di rischio costituzionale. Il secondo capitolo esamina l'architettura tecnica e istituzionale di FERMES, valutandone la compatibilità con i principi costituzionali di indipendenza del giudice, giusto processo e trasparenza algoritmica, nonché con il quadro normativo dell'AI Act europeo.
