This thesis examines the constitutional implications of digital manipulation in the age of generative artificial intelligence, with particular attention to the consequences that the ability to artificially create and alter images, videos, and voices has on the relationship between reality, information, and the individual. The study explores the relationship between digital manipulation and freedom of information, human dignity, and digital identity, while also examining phenomena such as deepfakes, biometric cloning, the Liar’s Dividend, and the manipulation of political communication. Particular attention is finally devoted to Multimedia Forensics tools and their relevance to establishing the authenticity of digital data and safeguarding the guarantees of a fair trial. The research shows that the issue concerns not only the ability to create false content, but also the growing difficulty of recognising and demonstrating what is authentic, thereby confronting constitutional law with the need to protect the individual, freedom of information, and the reliability of fact-finding in an increasingly manipulable digital reality.
La tesi analizza i profili costituzionali della manipolazione digitale nell’era dell’intelligenza artificiale generativa, con particolare attenzione alle conseguenze che la possibilità di creare e alterare artificialmente immagini, video e voci produce sul rapporto tra realtà, informazione e persona. Il lavoro prende in esame il rapporto tra manipolazione digitale e libertà di informazione, dignità e identità digitale, analizzando inoltre fenomeni quali deepfake, clonazione biometrica, Liar’s Dividend e manipolazione della comunicazione politica. Particolare attenzione è dedicata, infine, agli strumenti di Multimedia Forensics e alla loro rilevanza nell’accertamento dell’autenticità del dato digitale e nella tutela delle garanzie del giusto processo. La ricerca mostra come la questione non riguardi soltanto la possibilità di creare un falso, ma anche la crescente difficoltà di riconoscere e dimostrare ciò che è autentico, ponendo il diritto costituzionale di fronte alla necessità di tutelare la persona, la libertà di informazione e l’affidabilità dell’accertamento in una realtà digitale sempre più facilmente manipolabile.
