This thesis analyses the European Union’s digital trade agreements with third countries, with particular attention to the partnership between the European Union and Japan. The study examines the development of the European Union’s digital trade agreements with third countries, focusing specifically on the agreements between the European Union and Japan and on cross-border data flows. It also explores the role of personal data protection guaranteed by the European Union legal order in the context of digital trade agreements, with particular attention to the relationship between the liberalisation of cross-border data flows promoted by digital trade agreements and the protection of personal data ensured by the European regulatory framework. Finally, the thesis analyses the process of developing common standards between the EU and Japan in the field of digital trade, as well as the importance of technological cooperation within the broader context of global technological competition and the establishment of shared technological standards and common rules.
La presente tesi analizza gli accordi commerciali dell'Unione Europea con Paesi terzi in materia digitale, con particolare attenzione al partenariato tra Unione europea e Giappone. L'elaborato esamina lo sviluppo dei digital trade agreements dell'Unione europea con Paesi terzi, concentrandosi in particolare sugli accordi tra Unione europea e Giappone e sui flussi transfrontalieri di dati. Viene inoltre approfondito il ruolo del la tutela dei dati personali garantita dall'ordinamento dell'Unione europea nel contesto dei digital trade agreements, con specifica attenzione al rapporto tra la liberalizzazione dei flussi transfrontalieri di dati, promossa dagli accordi commerciali digitali, e la tutela dei dati personali garantita dal quadro normativo europeo. La tesi analizza infine il processo di creazione di standard comuni tra UE e Giappone nel settore del commercio digitale e l’importanza della cooperazione tecnologica nel più ampio contesto della competizione tecnologica globale, e della definizione di standard tecnologici, e regole comuni.
