IL TRUST PER LA PROTEZIONE DELLE PERSONE CON DISABILITÀ ED IL RUOLO DEGLI ETS

Analysis of the trust as a tool for the protection of people with disabilities within the Italian legal system. After examining the evolution of regulations and the relevant international framework, the study focuses on the role of Third Sector Entities (ETS) as trust managers. The analysis highlights how this instrument, if appropriately structured, can ensure effective asset protection and care provision, complementing the protection measures already established by law.

Analisi dell’istituto del trust come strumento di protezione delle persone con disabilità nell’ordinamento giuridico italiano. Dopo aver esaminato l’evoluzione normativa e la disciplina internazionale di riferimento, lo studio si concentra sul ruolo degli Enti del Terzo Settore (ETS) quali soggetti gestori del trust. L’analisi evidenzia come tale strumento, se opportunamente strutturato, possa garantire una tutela patrimoniale ed assistenziale efficace, integrando le misure di protezione già previste dalla legge.
