The aim of the present thesis is to investigate the phenomenon known as femicide or feminicide, which is considered as the killing of a woman because of her gender, in many contexts, such as private or public life. This particular type of murder, also considered as the most extreme manifestation of violence against women, is often perpetrated by the actual or former intimate partner of the victim, but it can also be committed by family members - such as brothers or fathers -, friends and, in some cases, even strangers. Analyzing and recognizing femicide as the most severe form of gender-based violence, this dissertation starts with a medico-legal perspective of the phenomenon by exposing the main fields of legal medicine, necessary to understand and to interpret femicide dynamics. It than proceeds to describe some femicide cases and to scrutinize the newly introduced statutory offense of femicide, currently established under the Italian Criminal Code. Finally, the research focuses on a comparative analysis of femicide in Latin American jurisdictions, specifically in Mexico, where Marcela Lagarde, a well-known feminist and academic figure, introduced the term “feminicide”, changing the neologism coined by Diana Russell known as “femicide”, to emphasize and highlight the role of the Mexican State in the proliferation of femicides in the country. The aforementioned comparative analysis has shown that in many Latin American countries, this type of violent murder is sanctioned with very heavy penalties and that it is also regulated as an independent criminal offense, demonstrating how Europe still lags behind in this regard.
La tesi si propone di analizzare il fenomeno del femminicidio da un punto di vista multidimensionale, coniugando l’analisi giuridica e l’evidenza scientifica ottenuta dalla medicina legale, avendo come obiettivo quello di definire un pattern medico-legale della fattispecie di reato, così che possano esserne analizzati i tratti più comuni, riconducibili ad una configurazione astratta, ma al contempo concretamente applicabile. L’analisi si concentrerà altresì sulle criticità riscontrate in merito alla formulazione normativa adottata dal legislatore, facendo riferimento alla preziosa relazione della Suprema Corte di Cassazione del 2026 in merito all’introduzione della Legge 181 del 2025, che appunto presenta la nuova fattispecie criminosa del femminicidio, apportando ulteriori modifiche a quel micro sistema normativo che ha ad oggetto la tutela dei diritti della donna e la lotta alla discriminazione di genere. Infine, il lavoro svolto terminerà con un’analisi comparata rispetto ai sistemi penali di altri ordinamenti giuridici, come quelli del Sud America, che incriminano già da anni il femminicidio, essendo sempre stato un fenomeno dilagante e particolarmente sensibile per la popolazione locale.
