This thesis examines the principle of due administrative procedure, tracing its historical and legal development with particular reference to the Italian legal system and to the role played by Law No. 241 of 1990. After reconstructing the gradual emergence of this principle, the study explores the contribution of both Italian and European case law to the definition and consolidation of procedural guarantees. The thesis then focuses on the participatory mechanisms introduced by Law No. 241 of 1990, highlighting their function, purpose, and significance within administrative proceedings. The overall aim is to show how the principle of due administrative procedure has progressively become a fundamental safeguard for individuals, while also promoting transparency, impartiality, and the proper functioning of administrative action.

Abstract
This thesis examines the principle of due administrative procedure, tracing its historical and legal development with particular reference to the Italian legal system and to the role played by Law No. 241 of 1990. After reconstructing the gradual emergence of this principle, the study explores the contribution of both Italian and European case law to the definition and consolidation of procedural guarantees. The thesis then focuses on the participatory mechanisms introduced by Law No. 241 of 1990, highlighting their function, purpose, and significance within administrative proceedings. The overall aim is to show how the principle of due administrative procedure has progressively become a fundamental safeguard for individuals, while also promoting transparency, impartiality, and the proper functioning of administrative action.| File | Dimensione | Formato | |
