Libertà di espressione e diritti fondamentali: un'analisi comparata tra il modello statunitense e quello europeo

This paper explores and compares the protection of freedom of expression in the United States and the European legal systems, focusing on their main similarities and differences in addressing contemporary issues such as hate speech, defamation, freedom of the press, and the regulation of online content on digital platforms. Although both systems share the common goal of safeguarding free democratic debate, they have developed distinct approaches to protecting freedom of expression. These differences reflect their respective constitutional traditions and the different ways in which they balance individual freedom with the protection of other fundamental rights.

La presente tesi analizza e mette in relazione la tutela della libertà di espressione nel sistema statunitense e quello europeo, evidenziando le principali convergenze e divergenze in relazione a temi di particolare attualità, quali i discorsi d'odio, la diffamazione, la libertà di stampa e la regolazione dei contenuti sulle piattaforme digitali. L'elaborato mostra come, pur perseguendo il comune obiettivo di garantire il libero dibattito democratico, i due sistemi abbiano sviluppato modelli di tutela differenti, espressione delle rispettive tradizioni costituzionali e dei diversi equilibri tra libertà individuale e tutela degli altri diritti fondamentali.
