This thesis aims to provide an analysis of the legal framework governing the late registration of canonical marriage and the principal civil-law effects arising therefrom within the Italian legal system. The study begins with an examination of concordat marriage as the result of the historical evolution of relations between the State and the Catholic Church, focusing in particular on the role of registration as the necessary mechanism for the recognition of the civil effects of a marriage celebrated according to the canonical rite. The first chapter is devoted to a historical reconstruction of matrimonial regulation in the relationship between the State legal system and the ecclesiastical legal system, from the establishment of civil marriage to the introduction of the concordat system through the Lateran Pacts of 1929. The thesis also examines the amendments introduced by the Villa Madama Agreement of 1984, as well as the legal framework governing marriages celebrated before ministers of worship belonging to religious denominations other than the Catholic Church. The second chapter analyses the legal framework governing the registration of canonical marriage, with particular attention to its function, legal nature, and procedural aspects. In this context, the thesis examines the principle of the voluntary nature of civil effects, the requirements imposed upon the parties involved in the registration procedure, and the principal civil effects deriving from the acquisition of marital status. The third chapter focuses on the late registration of canonical marriage, examining its requirements, procedure, and limits of application. The thesis also explores the issues arising in relation to challenges to late registration and posthumous registration. Finally, particular attention is devoted to the most significant civil effects produced by late registration and to the protection of third parties, highlighting the delicate balance between the recognition of the effects of canonical marriage and the need to ensure legal certainty within the State legal system.
