This paper aims to examine the phenomenon of demotion in the context of contracted public employment, paying particular attention to the delicate balance between the organizational power of the employer administration and the safeguarding of the professionalism of the public employee. The research stems from the evolution of public employment following the contractualization process, specifically analyzing the job regulations outlined in article 52 of Legislative Decree n.165/2001 and their relationship with article 2103 of the Civil Code. The peculiarity of the advertising system and the principle of formal equivalence of duties are highlighted. Subsequently, the exercise of ius variandi in public employment is explored in depth, outlining the limits within which the public employer can make changes to the employee's duties. Circumstances are identified in which assignment to lower duties can be considered legitimate, compared to those that constitute unlawful demotion. Particular attention is paid to the phenomena of job emptying and professional deskilling, with a specific focus on nursing staff, frequently involved in activities inconsistent with their professional profile. In its conclusion, the paper addresses the system of protections granted to public workers, examining aspects relating to the determination of employer default, the burden of proof, and compensation for damages resulting from deskilling and professionalism. This analysis draws on the most recent rulings of the Court of Cassation, which have contributed to redefining the boundaries of demotion in public employment, overcoming a purely quantitative interpretation of the prevalence criterion and valorizing the qualitative impact of inferior tasks on the professional dignity of the worker. The investigation concludes with an analysis of the possible connection between demotion, mobbing, and straining, highlighting the role of jurisprudence in strengthening the protection of professionalism as a value guaranteed by the Constitution.
