The object of the study is a critical analysis of the burden of proof institute. The first part investigates its rationale, its function, and its (substantial) nature, also in light of the most recent doctrinal positions (such as that of J. Nieva-Fenoll) that support its abolition. Then I analyze the difficulties that arise in distributing the evidentiary burden, in particular the identification of the impeding act, and I provide an example of this, examining the distribution of the burden of proof in warranty disputes for defects in the sold item.

Abstract
The object of the study is a critical analysis of the burden of proof institute. The first part investigates its rationale, its function, and its (substantial) nature, also in light of the most recent doctrinal positions (such as that of J. Nieva-Fenoll) that support its abolition. Then I analyze the difficulties that arise in distributing the evidentiary burden, in particular the identification of the impeding act, and I provide an example of this, examining the distribution of the burden of proof in warranty disputes for defects in the sold item.| File | Dimensione | Formato | |
