In my thesis project i examined the institutions of private leasing and rental law, in particular leasing and renting in the hotel business. In the first chapter i treated the store of the lease going to analyze its discipline within the Civil Code and dealing with various aspects including the duration of the relationship, the subject, the parts and obligations that fall on the landlord and the tenant. The second chapter is dedicate to renting, the discipline of which is contained in article 1615 of the Civil Code , going then to deepen its characteristics specifically. In the third chapter i analyzed the hotel contract in order to be able to make later a parallelism between the discipline of the hotel contract is that of the previously treated institutions of the lease and the rent. As for the fourth chapter i have deepened the institution of the lease with particular reference to the rental of urban properties going to talk about the rentals for reverse use from the house and all its characteristics. In the concluding chapter, i clarified the difference between hotel accommodation and rent by analyzing in particular law n. 27 of july 1978 and n.392 from articles 27 to 42.
Nel mio progetto di tesi sono andato ad analizzare gli istituti del diritto privato di locazione e affitto, in particolare la locazione e l’affitto nell’attività alberghiera. Nel primo capitolo ho trattato il negozio della locazione andando ad analizzare la sua disciplina all’interno del Codice Civile e trattandone i vari aspetti tra cui la durata del rapporto, l’oggetto, le parti e le obbligazioni che ricadono sul locatore e sul conduttore. Il secondo capitolo è dedicato all’affitto, la cui disciplina è contenuta all’interno dell’articolo 1615 del Codice Civile, andando poi ad approfondire le sue caratteristiche nello specifico. Nel terzo capitolo ho analizzato il contratto d’albergo al fine di poter fare successivamente un parallelismo tra la disciplina del contratto d’albergo e quella degli istituti precedentemente trattati della locazione e dell’affitto. Nel quarto capitolo ho approfondito l’istituto della locazione con particolare riferimento alla locazione degli immobili urbani andando a parlare delle locazioni ad uso diverso dall’abitazione e tutte le sue caratteristiche. Infine nel capitolo conclusivo sono andato a chiarire la differenza tra locazione alberghiera e affitto analizzando in particolare la legge 27 del luglio 1978 n. 392 dagli articoli 27 a 42.
