This thesis has the aim of analyzing, first historically and then with the latest jurisprudential decisions, the delicate issue of motivation within tax acts. The matter is closely connected with administrative law, so much so that many elements can only refer to what is examined in the administrative stage by both jurisprudence and doctrine. The Supreme Court of Cassation has never had a unanimous orientation on this point; which is why it is necessary to report what are the majority orientations, in order to draw a possible solution.
Tale tesi ha l'obbiettivo di analizzare, prima storicamente e poi con le ultime decisioni giurisprudenziali, il delicato tema della motivazione all'interno degli atti tributari. La materia è strettamente connessa con il diritto amministrativo, tant'è che molti elementi non possono che riferirsi a quanto vagliato in sede amministrativa sia da parte della giurisprudenza sia da parte della dottrina. Sul punto la Corte Suprema di Cassazione non ha mai avuto un orientamento unanime; motivo per cui è necessario riportare quelli che sono gli orientamenti maggioritari, al fine di trarre una possibile soluzione.
