Euthanasia practices are one of the most discussed topics in the contemporary landscape; therefore, it is useful to deepen the relationship between individual autonomy and legal paternalism within the legal and philosophical debate that underlies it. The aim is thus to outline and clarify the meaning of terms that revolve around this topic, as well as to provide details on how the national and international context regulates the matter. Next, the arguments concerning the right to life and the right to death play an important role, including their strengths, limitations and desirable coexistence. Finally, we focus on the various arguments for and against specifically concerning voluntary euthanasia including dignity, autonomy and slippery slope.
Le pratiche eutanasiche sono uno degli argomenti più discussi nel panorama contemporaneo; per questo, si rivela utile approfondire il rapporto che si instaura fra l’autonomia individuale e il paternalismo giuridico all’interno del dibattito giuridico e filosofico che ne sta alla base. Ci si propone di delineare e chiarire quindi il significato di termini che ruotano attorno a questo tema, nonché fornire dettagli su come il contesto nazionale e internazionale regoli la materia. Successivamente, giocano un ruolo importante le tesi riguardanti il diritto alla vita e al diritto alla morte, compresi i punti di forza, i limiti e l’auspicabile coesistenza. Infine, ci si focalizza sui vari argomenti favorevoli e contrari specificamente riguardanti l’eutanasia volontaria fra cui la dignità, l’autonomia e il pendio scivoloso.
