The thesis is focused on the topic of online disinformation in Europe and in Italy and the measurements taken to tackle the threat of fake news. At first, the study’s aim is to provide a definition to the term fake news and to show its multidimensional trait. A series of initiatives undertaken by the European Union on this issue is also presented, such as the Code of Practice on Disinformation in 2018. However, the main part of the work focuses on the comparison between Germany, where the so-called NetzDG law was enacted to protect users from online disinformation, and Italy, where a concrete law against fake news does not exist yet, although attempts to legally regulate them have not been lacking.
La tesi tratta il tema della disinformazione online in Europa e in Italia e le soluzioni contemplate per contrastare i pericoli delle fake news. Lo studio parte soffermandosi su questo termine che, a causa del suo carattere multidimensionale, presenta varie sfumature. Vengono inoltre, presentate una serie di iniziative intraprese dall’Unione europea su questo tema, come l’elaborazione del Codice di buone pratiche del 2018. La parte centrale del lavoro si concentra tuttavia, sulla comparazione tra la Germania, dove è stata emanata la c.d. legge NetzDG per tutelare gli utenti dalla disinformazione online, e l’Italia, dove una legge concreta contro le fake news tuttora non esiste, sebbene i tentativi di regolamentarle giuridicamente non siano mancati.
