Il regime assicurativo degli investimenti stranieri nella prospettiva del diritto internazionale pubblico e privato

The protection of foreign investments is a key issue for those who invest capital in a foreign country but are simultaneously afraid of the negative effects that political risk can have on the outcome of the investment. Thus arises the need for protection schemes that allows the investor to reduce political risk, while offering coverage if it occurs, and at the same time has the effect of encouraging the flow of foreign investment, in particular, towards developing countries. The insurance industry responds to these needs by developing, among other instruments, the Multilateral Investment Guarantee Agency (MIGA) as the most advanced form of foreign investment insurance. The aim of the thesis is therefore to extract through a study the insurance regime of foreign investments in the perspective of public and private international law the principles that still rule the subject.

La tutela degli investimenti stranieri rappresenta un tema chiave per coloro che investono capitale in uno stato straniero ma temono tuttavia gli effetti negativi che il rischio politico, di natura non commerciale, può comportare sul risultato dell'investimento. Nasce così l'esigenza di forme di tutela che permettano all'investitore di ridurre il rischio di natura creare politica, offrendogli contestualmente il riparo nel caso si realizzi, e che allo stesso tempo l'abbia effetto di incentivare il flusso degli investimenti stranieri, in particolare verso i paesi in via di sviluppo. Il settore assicurativo risponde a tali esigenze sviluppando tra gli altri strumenti l'Agenzia Multilaterale di Garanzia degli Investimenti (MIGA) quale forma più evoluta di assicurazione degli investimenti stranieri. Scopo della tesi è dunque ricavare attraverso uno studio del profilo pubblico e internazionalprivatistico del regime assicurativo degli investimenti stranieri i principi che ne regolano tutt'ora la materia.
