The thesis intends to bring light to the debate about the compensation for non-pecuniary damage under the discipline of Tort Law. The first part analyses the discussion between the doctrine and the jurisprudence about the evolution of the recognition for non-pecuniary loss, in order to protect constitutionalized human rights that have been violated. Secondly, let us focus on the role of the judge in assessing the case and the criteria for determining the amount of the liquidation.
La tesi intende portare alla luce il dibattito sulla categoria del danno non patrimoniale nella disciplina della responsabilità aquiliana. La prima parte analizza il dibattito tra dottrina e giurisprudenza in merito all’evoluzione del riconoscimento del danno non patrimoniale, alla luce della lesione di diritti umani costituzionalmente protetti. La seconda parte della ricerca si focalizza sul ruolo del giudice nella valutazione del caso e sui criteri per la determinazione del quantum da liquidare.
Responsabilità civile e danno non patrimoniale: verso la tutela effettiva ed integrale dei diritti della persona.
