L'orientamento sessuale nei sistemi universali e regionali di tutela dei diritti umani

The purpose of the research is an analysis and comparison of the positions of universal human rights protection bodies and regional ones on the issue of sexual orientation. In particular, an attempt will be made to highlight the existence of a difference in the degree of development of the level of protection offered and the rights guaranteed by the two types of systems, due mainly to the different instruments and purposes that characterize them and to the fact that while in the regional systems the member states are very "similar" to each other culturally and legally, the universal system includes, on the other hand, state realities that are very distant from each other. The first chapter will begin by examining the main interventions on the subject by the organs of the United Nations. In the second chapter, the focus will be on the European Court of Human Rights. It will conclude, in the third chapter, by looking at the contribution on the issue by existing regional human rights protection systems on the American and African continents.

Il fine della ricerca è rappresentato da un’analisi e da una comparazione tra le posizioni degli organi universali di tutela dei diritti umani e di quelli regionali in tema di orientamento sessuale. In particolare, si cercherà di evidenziare l’esistenza di una differenza nel grado di sviluppo del livello di protezione offerto e nei diritti garantiti dai due tipi di sistemi, dovuta principalmente ai diversi strumenti e finalità che li caratterizzano e al fatto che mentre nei sistemi regionali gli Stati membri sono molto “simili” tra loro dal punto di vista culturale e giuridico, del sistema universale fanno parte, invece, realtà statuali tra loro molto distanti. Nel primo capitolo si inizierà esaminando i principali interventi sul tema da parte degli organi delle Nazioni Unite. Nel secondo capitolo, l’attenzione sarà posta sulla Corte europea dei diritti dell’uomo. Si concluderà, nel terzo capitolo, guardando al contributo sulla questione da parte dei sistemi regionali di protezione dei diritti umani esistenti nel continente americano e in quello africano.
