Profili di tutela della privacy e trasferimento transfrontaliero dei dati personali

The paper aims to investigate, from a comparative perspective, the different approaches of Europe and the United States of America to privacy and personal data protection, also and especially in light of the opportunities and issues related to the cross-border flow of personal data. In addressing the first profile, the European one, the most significant innovations brought about by the EU Regulation No. 2016/679 (Gdpr) are investigated, as well as issues related to the use of the Internet and new technologies that allow the important economic value of personal data to be framed. The second chapter addresses a comparison on these issues with the United States, a country where, through a historical-regulatory framework, profound divergences with the European approach emerge. Finally, the paper draws important considerations on the highly topical issue of the cross-border transfer of personal data from Europe to the United States, examining recent rulings of the Court of Justice and its follow-up.

L'elaborato vuole indagare, in una prospettiva comparata, i differenti approcci di Europa e Stati Uniti d'America in materia di privacy e protezione dei dati personali, anche e sopratutto alla luce delle opportunità e delle problematiche connesse al flusso transfrontaliero dei dati personali. Nell'affrontare il primo profilo, quello europeo, si indagano le novità più significative apportate dal Regolamento Ue n. 2016/679 (Gdpr), nonché le tematiche connesse all'utilizzo di Internet e delle nuove tecnologie che consentono di inquadrare l'importante valore economico dei dati personali. Nel secondo capitolo viene affrontata una comparazione su questi temi con gli Stati Uniti, Paese in cui, attraverso un inquadramento storico-normativo, emergono profonde divergenze con l'approccio europeo. Infine, l'elaborato traccia importanti considerazioni sul tema, molto attuale, del trasferimento transfrontaliero dei dati personali dall'Europa verso gli Stati Uniti, esaminando le recenti pronunce della Corte di Giustizia e i suoi seguiti.
