The United Kingdom is considered in many ways the homeland of constitutionalism. Brilliant minds like John Locke theorised it, spreading their ideas worldwide. Yet the English constitutional experience presents aspects that clash with contemporary constitutional culture: it doesn’t have a written constitution, it doesn’t practise strict separation of powers, and it struggles to admit a control of constitutionality over laws. This is the paradox: the homeland of constitutionalism does not seem to practice its fundamental principles. The thesis tries to understand which of these paradoxes are real and which are apparent, and which are the compensation mechanisms implemented.
Il Regno Unito è considerata per molti versi la patria del costituzionalismo. Menti brillanti come John Locke lo hanno teorizzato e le loro idee si sono diffuse poi in tutto il mondo. Eppure l’esperienza costituzionale inglese presenta aspetti che stridono rispetto alla cultura costituzionale contemporanea: non ha una costituzione scritta, non pratica una rigida separazione dei poteri, fatica ad ammettere un controllo di costituzionalità sulle leggi. Questo è il paradosso: la patria del costituzionalismo sembra non praticarne i principi fondamentali. La tesi cerca di comprendere quali di questi paradossi siano reali e quali apparenti, e quali siano i meccanismi di compensazione attuati.
