Il decreto-legge n. 1/2023 (cd "Decreto ONG") e la normativa internazionale sui diritti dei migranti

This thesis focuses on Decree-Law No. 1/2023 (the so-called NGO Decree) and international legislation on the rights of migrants. The drafting of the same was carried out on the basis of data collected by consulting the legal and regulatory measures, decrees, the indications provided by the ministry and the examination of some newspapers, that from November 2022 have dealt with the topics of interest. Following a brief introduction, the first chapter dealt with the doctrinal thesis on immigration; to follow the changes in the matter of reception to migrants and the code of conduct of NGOs. With regard to the second chapter, the focus was on the views of the political debate in a legal sense and on what legal arguments were mentioned. In addition, the measures mentioned have been identified. In the third chapter, instead, a systematic collection of what was reported in the newspapers was made. Two newspapers were considered, one more critical of the Meloni government and one more supportive. Legal and regulatory measures were also considered. Finally, in the fourth and last chapter more comments were added. After these premises, the research question to be answered is "how does the so-called NGO Decree want to change the current legislation on the rights of migrants?".

Questa tesi di laurea pone come oggetto di ricerca il decreto-legge n. 1/2023 (il cosiddetto Decreto ONG) e la normativa internazionale sui diritti dei migranti. La stesura della stessa è stata effettuata sulla base dei dati raccolti consultando le misure giuridiche e normative, decreti, delle indicazioni fornite dal ministero e l’esaminazione di alcune testate giornalistiche, che a partire dal novembre 2022 abbiano trattato gli argomenti di interesse. A seguito di una breve introduzione, nel primo capitolo è stata trattata la tesi dottrinale riguardo l’immigrazione; a seguire le modifiche in materia di accoglienza ai migranti e il codice di condotta delle ONG. Per quanto riguarda il secondo capitolo, ci si è concentrati sulle opinioni del dibattito politico in chiave giuridica e su quali argomenti di tipo giuridico siano stati menzionati. Inoltre, sono state identificate le misure di cui si parla. Nel terzo capitolo, invece, è stata fatta una raccolta sistematica di cosa è stato riportato sui giornali. Sono stati presi in considerazione due testate giornalistiche, una più critica nei confronti del governo Meloni e una più assecondante. Sono state inoltre considerate le misure giuridiche e normative. Infine, nel quarto e ultimo capitolo sono stati aggiunti altri commenti. Dopo queste premesse, la domanda di ricerca a cui si vuole rispondere è “in che modo il cosiddetto Decreto ONG vuole modificare la normativa vigente in materia di diritti dei migranti?”.
