La vittima e la pena: un confronto tra giustizia riparativa e istanze vittimo-centriche

When we talk about retribution, we are not doing something new. However, the focus on the victim of crime and restorative justice is perceived in different spheres: media, juridical, political, social. Both themes are intimately linked to that of punishment: who needs it? What basis justifies it? What objective can or should it achieve? The paper attempts to consider these questions in the light of a comparison between restorative justice and victim-centred demands, in order to arrive at an assessment not only of the validity of the former, but also of its possible necessity.

Quando si parla della pena, non si fa qualcosa di nuovo. Tuttavia, l'attenzione per la vittima del reato e per la giustizia riparativa è percepita in diversi ambiti: mediatico, giuridico, politico, sociale. Entrambi i temi sono intimamente legati a quello della punizione: chi ne ha bisogno? Quali basi la giustificano? Quale obiettivo può o deve raggiungere? L'elaborato cerca di considerare queste domande alla luce di un confronto tra la giustizia riparativa e le istanze vittimo-centriche, per giungere ad una valutazione non solo della validità della prima, ma anche della sua eventuale necessità.
