This thesis focuses on the international relations that Cuba has with its main opponent, the United States, and with its exiled community, particularly the enclave of American Cubans in Miami. The period of time considered begins in 1959, the year of the Castro Revolution, to reach the present day. The imprint that characterizes this work is, therefore, both political and legal. Through a historical overview of international relations between these two countries, the two main laws of US foreign policy will be addressed: «Ley de Ajuste Cubano» and the «Ley pies secos, pies mojados», which have made Cuban citizens the beneficiaries of a «special» refugee status, which exempts them from US national migration laws and thus distinguishes them from asylum seekers from other countries. It will also take into account the various testimonies by the hard core of the Cuban community present in Miami; other Cubans exiled; and those who remained in Cuba. Finally, considering the action of the Cuban diaspora as mediator of a possible reconciliation between Cuba and the United States.
La presente tesi pone l’attenzione sulle relazioni internazionali che Cuba intrattiene con il suo principale oppositore, gli Stati Uniti, e con la sua comunità esiliata, in particolare l’enclave di cubani statunitensi a Miami. Il periodo di tempo considerato inizia dal 1959, anno della Rivoluzione castrista, per giungere ai giorni nostri. L’impronta che caratterizza questo elaborato è, dunque, sia politologica che legale. Attraverso un excursus storico delle relazioni internazionali tra questi due paesi, si affronteranno le due principali leggi di politica estera statunitense: la «Ley de Ajuste Cubano» e la «Ley pies secos, pies mojados», che hanno reso i cittadini cubani fruitori di uno status di rifugiato «speciale», che li esonera dalle leggi nazionali statunitensi in materia di migrazione e li distingue così dai richiedenti asilo provenienti da altri paesi. Si terrà conto, inoltre, delle diverse testimonianze da parte del nucleo duro della comunità cubana presente a Miami; di altri cubani esiliati; e di chi invece è rimasto a Cuba. Considerando, infine, l’azione della diaspora cubana come mediatore di una possibile conciliazione tra Cuba e gli Stati Uniti.
