History is what shapes man, how can he have the right to forget it? This is a fundamental question that will be proposed in the course of the discussion, however having multiple answers. The subject of this thesis is, therefore, a close examination of the relationship between historical memory and the right to be forgotten in the World Wide Web era. The discussion will begin with a study of the main national and European sources of the right to be forgotten. It will then continue with an analysis of the key case of the whole issue, the so-called Google Spain, which then led to the inclusion of the right to be forgotten (in particular) in Article 17 of the General Data Protection Regulation. Finally, space will be given to a philosophical parenthesis, analyzing the thought and relationship of Heidegger and Nietzsche with the theme of oblivion. A topic that, fortunately, I was able to deepen during my internship experience dealing with de-indexing requests for harmful links. The last chapter will in fact be dedicated to this experience, which is important and fundamental in providing a more practical and less abstract point of view on the subject of the right to be forgotten.
La storia è ciò che plasma l’uomo, come può egli avere il diritto a dimenticarla? Questa è una domanda fondamentale che verrà proposta nel corso della trattazione, avente tuttavia molteplici risposte. Oggetto del presente lavoro di tesi è, dunque, una disanima del rapporto che intercorre tra memoria e diritto all’oblio con l’avvento dell’era del World Wide Web. La trattazione inizierà con uno studio delle principali fonti del diritto all’oblio, nazionali ed europee. Proseguirà successivamente con un’analisi del caso chiave dell’intera tematica, il cosiddetto Google Spain, che ha poi portato all’inclusione del diritto all’oblio (in particolare) nell’articolo 17 del General Data Protection Regulation. Infine, spazio verrà dato ad una parentesi filosofica, analizzando il pensiero e il rapporto di Heidegger e Nietzsche con il tema dell’oblio. Tema che, fortunatamente, ho avuto modo di approfondire durante la mia esperienza di tirocinio occupandomi di richieste di deindicizzazione di link lesivi. L’ultimo capitolo sarà dedicato difatti a tale esperienza, importante e fondamentale nel fornire un punto di vista più pratico e meno astratto sul tema del diritto all’oblio.
