The Belt and Road Initiative involves multiple countries and significant financial investments but relies primarily on soft law instruments for partnership. Consequently, there is currently no resolution mechanism in place to settle disputes that may arise along the Route. To address this, this thesis examines traditional dispute resolution methods and their applicability to BRI disputes. Domestic courts, arbitration, and mediation are found to be insufficient for resolving BRI disputes. The thesis then explores China's efforts to establish a BRI-specific dispute resolution mechanism by creating the Chinese International Commercial Courts, ultimately concluding that these efforts have not been successful.

Abstract
The Belt and Road Initiative involves multiple countries and significant financial investments but relies primarily on soft law instruments for partnership. Consequently, there is currently no resolution mechanism in place to settle disputes that may arise along the Route. To address this, this thesis examines traditional dispute resolution methods and their applicability to BRI disputes. Domestic courts, arbitration, and mediation are found to be insufficient for resolving BRI disputes. The thesis then explores China's efforts to establish a BRI-specific dispute resolution mechanism by creating the Chinese International Commercial Courts, ultimately concluding that these efforts have not been successful.File | Dimensione | Formato | |
