IL CONTRIBUTO DELLE ORGANIZZAZIONI INTERNAZIONALI ALLO SVILUPPO DELLE NORME SULLA PROTEZIONE DEGLI INVESTIMENTI STRANIERI

This research work aims to describe how different types of International Organizations operate in the field of foreign direct investment and how their efforts contribute to the development of rules and other instruments aimed at protecting foreign investors and their investments. First, we introduce the notion of International Organization and it is explained how their work has intertwined with the issue of foreign investment over time. Subsequently, the research focuses on the role of International Organizations as key actors influencing the domestic investment policy choices of states, mainly through the promotion of investment policy standards and technical assistance. The focus here is on the work and major initiatives of the World Bank Group, the Organization for Economic Co-operation and Development (OECD), the United Nations Conference on Trade and Development (UNCTAD) and the United Nations Commission on International Trade Law (UNCITRAL). The focus of the research then shifts to the ability of some international organizations to conclude agreements that regulate foreign investment or that include provisions on the protection of foreign investment. The focal points of this chapter is the regionalization of investment agreements and the main actors are Regional Organizations such as the European Union, ECOWAS and ASEAN. In this part we will analyze their investment frameworks and consider the most recent and sophisticated agreements that each of them has concluded to protect foreign investment between their member states. The analysis of all these agreements will focus on the provisions on standards of treatment of investors and the rules on dispute resolution mechanisms.

Questo lavoro di ricerca mira a descrivere come diversi tipi di organizzazioni internazionali operano nel campo degli investimenti diretti esteri e come i loro sforzi contribuiscono allo sviluppo di regole e altri strumenti volti a proteggere gli investitori stranieri e i loro investimenti. In primo luogo, si introduce la nozione di Organizzazione Internazionale e si spiega come il loro lavoro si sia intrecciato nel tempo con la questione degli investimenti esteri. Successivamente, la ricerca si concentra sul ruolo delle organizzazioni internazionali come attori chiave che influenzano le scelte di politica di investimento degli stati, principalmente attraverso la promozione di standard di investimento e tramite l'assistenza tecnica. Al centro dell'attenzione vi sono i lavori e le principali iniziative del Gruppo della Banca mondiale, dell'Organizzazione per la Cooperazione e lo Sviluppo Economico (OCSE), della Conferenza delle Nazioni Unite per il Commercio e lo Sviluppo (UNCTAD) e della Commissione delle Nazioni Unite per il Diritto Commerciale Internazionale ( UNCITRAL). Il focus della ricerca si sposta poi sulla capacità di alcune organizzazioni internazionali di concludere accordi che regolano gli investimenti esteri o che includono disposizioni sulla protezione degli investimenti esteri. Il punto focale di questo capitolo è la regionalizzazione degli accordi di investimento e gli attori principali sono le organizzazioni regionali come l'Unione europea, l'ECOWAS e l'ASEAN. In questa parte analizzeremo i loro panorama normativo sugli investimenti esteri e prenderemo in considerazione gli accordi più recenti e sofisticati che ognuno di loro ha concluso per proteggere gli investimenti esteri tra i loro stati membri. L'analisi di tutti questi accordi si concentrerà sulle disposizioni sugli standard di trattamento degli investitori e sulle norme riguardanti i meccanismi di risoluzione delle controversie.
