The present work aims to delve into an analysis of the Moroccan constitution. It becomes particularly pertinent as the latest version of the constitution was enacted in 2011, amidst the backdrop of the transformative north African uprisings widely referred to as the “Arab Spring”. This study aims to assess the extent to which these new provisions contribute to the process of modernization within Moroccan society. With particular emphasis placed on two fundamental pillars that underpin the Moroccan constitution: religious law and civil law. The examination of these pillars serves to highlight the intricate challenge of reconciling these seemingly dissimilar elements within the constitutional framework.
