L'attribuzione del cognome ai figli: la Corte costituzionale si sostituisce al legislatore silente

The first part of the thesis is about the definition of personal identity and its constitutional protection. Then the focus is on the surname of children, national and international jurisprudence compared with examples of legal debates. The third part concentrates on conflicts between parents for the assignment of the surname to children and the inertia of the legislator in regulating this matter.

La prima parte della tesi si concentra sulla definizione dell'identità personale e la sua tutela costituzionale. Successivamente il focus è sul cognome dei figli, la giurisprudenza nazionale e quella internazionale a confronto con esempi di dibattiti giuridici. La terza parte si concentra sui conflitti tra i genitori per l'assegnazione del cognome ai figli e l'inerzia del legislatore nel regolare questa materia.
