The recent constitutional reform n. 1 of 2022 has modified the articles 9 and 41 of the Constitution, adding new limits that can oppose the freedom of private economic initiative, in favour of the protection of the environment and human health. It is being debated whether these new limits are simply repeating of the concept of "social utility" contained in the original text of article 41 of the Constitution or whether they are necessary clarifications to avoid damaging our health or the environment.
La recente riforma costituzionale n. 1 del 2022 ha modificato gli articoli 9 e 41 della Costituzione, aggiungendo nuovi limiti alla libertà d'iniziativa economica a favore della tutela alla salute e all'ambiente. Si discute se questi nuovi limiti siano una semplice ripetitività al concetto di “utilità sociale” contenuto nel testo originale dell’ articolo 41 Cost. o se siano precisazioni necessarie per evitare che si verifichino nuovi danni alla salute o all’ambiente.
