The paper deals with two distinct issues in the legislative field, but which came together in the circumstances of the exhibition "I, Canova. European Genius" at the Civic Museums of Bassano del Grappa. The first part deals with the discovery of the statue of the Lying Magdalene by Antonio Canova in a private garden in England, with an analysis of English law in the context of the discovery of a cultural asset and subsequently on the importation of the statue into Italy for the exhibition. The second theme of the paper is the failure to import, on the occasion of the exhibition, some works of art by Antonio Canova from Kiev and St. Petersburg. The negotiations for the temporary return of the statues stalled in February 2022, on the eve of the war events affecting the countries of the cities that keep the statues, specifically analyzing the rules and the dynamics of the ban on exports due to war both in Ukraine and in Russia.
L'elaborato affronta due tematiche distinte in ambito legislativo, ma che si sono unite nelle circostanze della mostra "Io, Canova. Genio Europeo" ai Musei Civici di Bassano del Grappa. La prima parte trattata ha come oggetto il ritrovamento della statua della Maddalena Giacente di Antonio Canova in un giardino privato in Inghilterra, con un'analisi del diritto inglese in ambito della scoperta di un bene culturale e successivamente sull'importazione della statua in Italia per la mostra. La seconda tematica dell'elaborato è la mancata importazione, in occasione della mostra, di alcune opere di Antonio Canova da Kiev e San Pietroburgo. Le trattative per il rientro temporaneo delle opere si sono bloccate nel febbraio 2022, alla vigilia degli eventi bellici che interessano i paesi delle città custodi delle statue, nello specifico si analizzano le norme e le dinamiche intercorse di divieto di esportazione per cause belliche sia in Ucraina e in Russia.
