LIBERA CIRCOLAZIONE DELLE COPPIE DELLO STESSO SESSO NELL'UNIONE EUROPEA

The thesis aim is to examine the right to free movement, focusing on the freedom of movement of same-sex couples in the light of recent rulings by the Court of Justice of the European Union. The first part of the thesis analyzes the evolution of the right to free movement and residence, with the analysis of the directive 2004/38/EC; in particular, the family members admitted to reunification will be identified as explained in the directive in art.2. In the second part of the thesis two sentences of the Court of Justice will be analysed: the “Coman” sentence and the “Banger” sentence. The "Coman" case concerns the right of residence of the same-sex spouse of an EU citizen, in the event that the Member State of origin to which the citizen intended to return after exercising the right of free movement does not recognize marriages between people of the same sex. The "Banger" case concerns the protection of the family life of unregistered cohabiting couples.

La tesi si propone di esaminare il diritto alla libera circolazione, focalizzandosi sulla libertà di movimento della coppie dello stesso sesso alla luce di recenti sentenze della Corte di Giustizia dell'Unione europea. La prima parte della tesi analizza l'evoluzione del diritto alla libera circolazione e di soggiorno, con l’analisi della direttiva 2004/38/CE,;in particolare saranno individuati i familiari ammessi al ricongiungimento esplicitati nella direttiva all' art.2. Nella seconda parte della tesi saranno analizzate due sentenze della Corte di Giustizia: la sentenza “Coman” e la sentenza “Banger”. Il caso “Coman” riguarda il diritto di residenza del coniuge dello stesso sesso di un cittadino dell'Unione, nel caso in cui lo Stato membro di origine in cui il cittadino intendeva fare ritorno dopo aver esercitato il diritto di libera circolazione non riconosca i matrimoni tra persone dello stesso sesso. Il caso “Banger” è relativo alla tutela della vita familiare delle coppie conviventi non registrate.
