L'efficacia probatoria dell'e-mail nel processo civile

The thesis analyzes the evidential effectiveness of emails (PEC and PEO) in civil proceedings, in relation to the digital revolution that has transformed the legal system. The text is divided into three parts: the first part introduces the concept of electronic document and electronic signature, distinguishing the different types and their legal effects. The second part focuses on certified electronic mail (PEC), equivalent to registered mail with return receipt, and on its attachments which require a digital signature to acquire legal value. The third part examines the probative value of the ordinary e-mail, comparing the two orientations: one, which traces it back to the electronic document referred to in Article 20, paragraph 1-bis, of the CAD, and the other which considers it devoid of signs and inserts it in the catalog of computer reproductions referred to in article 2712 of the Civil Code.

La tesi analizza l’efficacia probatoria delle e-mail (PEC e PEO) nel processo civile, in relazione alla rivoluzione digitale che ha trasformato il sistema giuridico. Il testo si articola in tre parti: la prima parte introduce il concetto di documento informatico e di firma elettronica, distinguendo le diverse tipologie e i loro effetti giuridici. La seconda parte si concentra sulla posta elettronica certificata (PEC), equiparata alla raccomandata con ricevuta di ritorno, e sui suoi allegati che necessitano di firma digitale perché acquisiscano valore legale. La terza parte esamina il valore probatorio delle e-mail ordinaria, confrontando i due orientamenti: uno, che la riconduce al documento informatico di cui all’articolo 20, comma 1-bis, del CAD, e l’altro che la considera priva di firma e la inserisce nel catalogo delle riproduzioni informatiche di cui all’articolo 2712 del Codice civile.
