Intercettazioni e protezione dei diritti fondamentali: un difficile bilanciamento tra esigenze repressive e tutela dell'indagato

The thesis focuses on the compatibility of the investigative tool of wiretapping with fundamental human rights, particularly the right to privacy and the right to the inviolability of the domicile. After a detailed historical and comparative analysis of the processing and use of wiretapping, were examined the characteristics and technical aspects that define this tool. The impact of the latter on the right to privacy was then assessed, paying attention, first of all, to the historical evolution and sources that regulate this right, and then focusing on the relationship between this right and this means of searching evidence. Secondly, the thesis addresses the impact of wiretapping on the right to the inviolability of the home under article 14 of the Constitution, attempting to identify the scope of application of this provision.

Il lavoro ha ad oggetto la compatibilità del mezzo investigativo delle intercettazioni con i diritti fondamentali dell’uomo e, in particolare, con il diritto alla privacy e il diritto all’inviolabilità del domicilio. Dopo un approfondimento di tipo storico e comparato sull’elaborazione e sull’uso delle intercettazioni, si sono esaminate le caratteristiche e gli aspetti tecnici che connotano tale strumento. Si è poi misurato l’impatto delle intercettazioni sul diritto alla privacy, ponendo attenzione, anzitutto, sull’evoluzione storica e alle fonti che disciplinano tale diritto, per poi concentrarsi sulla relazione tra questo e il mezzo di ricerca della prova in esame. In secondo luogo, la tesi affronta l’impatto delle intercettazioni sul diritto all’inviolabilità del domicilio previsto dall’art. 14 Cost., cercando di individuare l’ambito applicativo di tale previsione.
