The present thesis focuses on an analysis of the impact of the so-called generative AI within the field of copyright law. After explaining the concepts of human intelligence, creativity, and their relationship with AI, we will discuss the challenges that digital innovation and robotic creativity pose to creators of intellectual works. Subsequently, we will attempt to identify the applicable framework for works created using generative AIs, specifically considering AI as a tool to support human creativity and AI as an author. In this regard, we will examine the primary sources of copyright law at the national, European, and international levels, along with recent insights provided by scholarly discourse and legal judgments. We will then try to outline potential future developments.
Il presente lavoro di tesi ha per oggetto un’analisi dell’impatto dell’IA cosiddetta generativa nell’ambito della disciplina del diritto d’autore. Dopo aver illustrato i concetti di intelligenza e creatività umane ed il loro rapporto con l’IA, si accennerà alle sfide che l’innovazione digitale e la creatività robotica pongono ai creatori di opere dell’ingegno. Successivamente, si cercherà di identificare la disciplina applicabile alle opere create utilizzando le IA generative, con riferimento in particolare all'IA come strumento di supporto alla creatività umana e all'IA come autore. A questo proposito si analizzeranno le principali fonti in tema di diritto d’autore a livello nazionale, europeo ed internazionale, alcune delle recenti indicazioni date dalla dottrina e da pronunce giurisprudenziali, per poi cercare di delineare possibili sviluppi futuri.
