La Tortura nello Stato costituzionale

In the second chapter, the focus shifts to the changing conception of torture following 9/11 and its impact on democracy. In general, the thesis aims to analyze how the crime of torture is a symptom of the crisis of democracy and its functioning as a constitutional state.

"Il reato di tortura e lo stato costituzionale" si concentra sulla crisi della democrazia in relazione alla tortura. Nel primo capitolo, viene fornita una definizione della tortura, con un breve excursus storico del suo uso nel contesto del potere e della violenza. Nel secondo capitolo, l'attenzione si sposta sul mutamento della concezione della tortura a seguito dell'11 settembre e del suo impatto sulla democrazia. In generale, la tesi si propone di analizzare come il reato di tortura sia un sintomo della crisi della democrazia e del suo funzionamento come stato costituzionale.
