La responsabilizzazione delle imprese verso i diritti umani nel quadro dell’ONU: il caso del settore estrattivo

The aim of the thesis is to present the accountability tools and initiatives to empower companies operating in the extractive industry. The tools identified refer to the guidelines drawn up by John Ruggie in 2011 called "United Nations Guiding Principles on Business and Human Rights", which aim to implement the tripartite framework of Respect, Protect, Remedy of the United Nations in order to integrate the protection of human rights in the extractive practices of companies, involving both the states in which the companies are based and those in which they operate. Over the years, with the development of the international system of human rights, transparency initiatives such as the well known "Extractive Industries Transparency Initiative" have been created, but they do not have a decisive role in the monitoring phase: to this critical aspect of the tools and initiatives created so far, the "Corporate Social Responsibility Agency" model proposes a solution that will be analyzed.

La tesi ha l’obiettivo di presentare gli strumenti e le iniziative di responsabilizzazione delle imprese operanti nel settore estrattivo. Gli strumenti individuati fanno riferimento alle linee guida elaborate da John Ruggie nel 2011 “United Nations Guiding Principles on Business and Human Rights”, che mirano ad implementare il framework tripartito di Respect, Protect, Remedy delle Nazioni Unite al fine di integrare la tutela dei diritti umani nelle pratiche estrattive delle imprese, coinvolgendo sia gli stati in cui le imprese hanno sede, sia quelli in cui operano. Nel corso degli anni, con lo sviluppo del paradigma dei diritti umani a livello internazionale, sono nate iniziative di trasparenza come la nota “Extractive Industries Transparency Initiative”, che però non hanno un ruolo decisivo nella fase di monitoraggio: a questa criticità degli strumenti creati finora, il modello della “Corporate Social Responsibility Agency” propone una soluzione che verrà analizzata.
