Affido sine die e adozione mite, il tentativo di superare la dicotomia tra affidamento e adozione

In the matter of protection, in Italian family law, the custody sine die is a legal institution contra legem, because it does not respect the indication on the duration of custody estabilished by Law 149 of 2001. Mild adoption, on the other hand, is an institution not provided for by the Italian legal system, therefore without specific legislation, but justified by jurisprudence thanks to the letter d, article 44, in low about adoptions and foster care. Despite these premises, the two institutes have become common and frequent practices, often proving necessary. The aim of the thesis is to analyze the evolution of legislation in this regard and any gaps in the legislation, to comment on the characteristics of these two institutes, with attention to both their criticalities and their importance and to discuss their functionality

In tema di Tutela, nel diritto di famiglia italiano, l'affido sine die è un istituto giuridico "contra legem", poiché non rispetta l'indicazione sulla durata dell'affido dettata dalla Legge 149 del 2001. L'adozione mite invece è un istituto non previsto dall'ordinamento giuridico italiano, quindi priva di una normativa specifica, ma giustificato dalla giurisprudenza grazie alla lettera d dell'articolo 44 della legge sulle adozioni e gli affidi. Nonostante queste premesse, i due istituti sono diventati pratiche comuni e frequenti, rivelandosi molto spesso necessari. La tesi ha l'obbiettivo di analizzare l'evoluzione della legislazione a questo proposito e gli eventuali vuoti normativi, di commentare le caratteristiche di questi due istituti, con attenzione sia alle loro criticità sia alla loro importanza e di discuterne la loro funzionalità.
