L'inclusione delle attività di trasporto nell'European Union Emission Trading System: prospettive dell'ordinamento italiano

Considering the serious environmental consequences related to climate change and the need for a reaction from the Institutions; due to the recent inclusion of maritime transport within the scope of the European Union Emission Trading System, this contribution aims to describe the evolution of this legal tool, as the primary instrument of the European Union’s climate policy, that has been introduced for the first time by the Directive 2003/87/EC. The thesis is divided into three chapters: the first one introduces the European Union Emission Trading System as it describes its background and functioning, taking into consideration its transposition in the Italian legal system. The second and third chapters focus on the analysis of the extension European Union Trading System to aviation and shipping, because of the great amount of emissions caused by transportation, and they provide a comparison between the two regulations.

Alla luce delle sempre più evidenti conseguenze ambientali legate al cambiamento climatico e della necessaria risposta da parte delle Istituzioni; considerata la recente inclusione del trasporto marittimo nell’ambito di applicazione dell’European Union Emission Trading System, il presente contributo si propone di descrivere l’evoluzione normativa dell’istituto in parola, quale principale strumento della politica climatica dell’Unione Europea, introdotto per la prima volta con la direttiva 2003/87/CE. L’elaborato si articola in tre capitoli: il primo capitolo ha carattere generale poiché è dedicato alla descrizione delle premesse e del funzionamento del sistema europeo per lo scambio delle quote di emissioni, con particolare attenzione al recepimento dello stesso nell’ordinamento italiano. Nel secondo e nel terzo capitolo è presa in considerazione l’estensione del sistema di emission trading europeo all’aviazione e al trasporto marittimo, in ragione del rilevante ammontare di emissioni generate dal settore dei trasporti, ed è operata una comparazione tra l’adozione delle due discipline.
