The European integration process has started a path of democratic strengthening which has contributed to the expansion and consolidation of political, social and civil rights. As stated in Article 2 of the Treaty on European Union (TEU), the Union is founded on a set of values common to all Member States, the acceptance and respect of which constitute an essential condition for the membership of the Union. Among the various values, the rule of law plays a central role on the European scene. Shaped around the idea of the State, it is the result of a historical evolution including a plurality of legal and political traditions, which over time has led to question its own content, its scope and above all the legal instruments necessary for its protection.
Il processo di integrazione europea ha avviato un percorso di rafforzamento democratico che ha contribuito all’espansione e al consolidamento di diritti politici, sociali e civili. Come enuncia l’articolo 2 del Trattato dell’Unione europea (TUE), l’Unione si fonda su un complesso di valori comuni a tutti gli Stati membri, la cui accettazione e il cui rispetto costituiscono condizione imprescindibile per l’appartenenza all’Unione. Tra i vari valori, un ruolo centrale sulla scena europea lo svolge lo Stato di diritto. Plasmato attorno all’idea di Stato costituisce il risultato di una evoluzione storica comprensiva di una pluralità di tradizioni giuridico-politiche, che ha portato nel tempo ad interrogarsi circa il suo contenuto, la sua portata e soprattutto gli strumenti giuridici necessari per la sua tutela.
