Biodiversità e Costituzione: le immissioni di specie ittiche alloctone d'acqua dolce

The objective of this thesis is to illustrate the evolution of the protection of the environment and biodiversity in the Italian Constitution and the division of legislative competences between the State and the regions in this matter, in order to analyze the problem concerning the introduction of alien fish species in national river basins. The starting point is a short description of the situation of serious vulnerability in which the native ichthyofauna is found caused by repopulation activities carried out with non-native fish species, to then explain the European and national protection system, the sentences of the Constitutional Court and the decisive role of the Government, up to the most recent legislative updates on the subject.

L'obiettivo di questa tesi è quello di illustrare l'evoluzione della tutela dell'ambiente e della biodiversità nella Costituzione italiana ed il riparto delle competenze legislative tra lo Stato e le regioni in questa materia, al fine di analizzare il problema riguardante le immissioni di specie ittiche alloctone nei bacini idrografici nazionali. Il punto di partenza è una sintetica descrizione della situazione di grave vulnerabilità in cui viene a trovarsi l'ittiofauna autoctona a causa delle attività di ripopolamento effettuate con materiale ittico non nativo, per poi approfondire il sistema europeo e nazionale di tutela, le sentenze della Corte costituzionale ed il ruolo determinante del Governo, fino agli aggiornamenti normativi più recenti sul tema.
