Separazione e divorzio: l'evoluzione degli istituti

The thesis aims to illustrate the institutions of separation and divorce, and to analyze the regulatory sources of family law: Constitution, national regulations, European standards. The legal concept of indissolubility of marriage, the figure of the spouse, the child and the mutual relationships between these will be explored in depth. Furthermore, a comparison will be made between the original conception of family and the current one, in light of the changes that have occurred over the years. We will proceed by analyzing the institutions of separation and divorce, in depth, also in light of law 55/2015 which introduced the so-called. short divorce. Finally, we will address a more recent topic: the Cartabia Reform (Law 137/2021), implemented through Legislative Decree no. 50 of 10 October 2022.

L'elaborato ha l'obiettivo di illustrare gli istituti della separazione e del divorzio, e di analizzare le fonti normative del diritto di famiglia: Costituzione, normative nazionali, norme europee. Sarà approfondito il concetto giuridico di indissolubilità del matrimonio, la figura del coniuge, del figlio e i rapporti reciproci tra questi. Si farà, inoltre, un confronto tra la concezione originaria di famiglia e quella attuale, alla luce dei cambiamenti avvenuti negli anni. Si procederà analizzando gli istituti della separazione e del divorzio, in modo approfondito, anche alla luce della legge 55/2015 che ha introdotto il cd. divorzio breve. In conclusione, si affronterà un argomento più recente: la Riforma Cartabia (Legge 137/2021), attuata mediante il Decreto Legislativo n. 50 del 10 ottobre 2022.
