The study goes on to analyse the historical-normative evolution of the national civil protection system from the first decrees of the Kingdom of Italy to the birth of the Code (Legislative Decree no. 1 of 2 January 2018), analysing the various reforms. The paper delves into the various competences and powers at the emergency level and how the state of emergency is actually managed. Then it examines the figure of the volunteer, a key element underpinning this system. The thesis refers to the main regulatory sources in the field of safety, highlighting the volunteer's exposure to risk during the performance of his or her activity and the consequent specific training to deal safely with his or her tasks. Finally, the paper highlights how legislation in the field of safety in the workplace also protects volunteers and how volunteers have responsibilities that vary according to their qualification and role.
Lo studio va ad analizzare l’evoluzione storico-normativa del sistema nazionale di protezione civile dai primi decreti del Regno d’Italia fino alla nascita del Codice (d.lgs. 2 gennaio 2018, n. 1), analizzando le varie riforme. Nello scritto si approfondiscono le varie competenze e poteri a livello emergenziale e di come venga effettivamente gestito lo stato di emergenza. Successivamente viene esaminata la figura del volontario, elemento chiave alla base di questo sistema. La tesi fa riferimento alle principali fonti normative in ambito di sicurezza, evidenziando l’esposizione al rischio del volontario durante lo svolgimento della sua attività e della conseguente formazione specifica per affrontare in sicurezza le proprie mansioni. Infine l’elaborato evidenzia come la normativa in ambito di sicurezza sul luogo di lavoro vada a tutelare anche i volontari e come quest’ultimi abbiano delle responsabilità che variano a seconda della qualifica e del ruolo che ricoprono.
