I rimedi giustiziali previsti in Italia per la tutela della privacy

The paper covers the two tracks of protection that individuals have to protect themselves in the event of a privacy breach, protection before the Data Protection Authority and recourse to the ordinary courts. After delving into what is meant by privacy and data protection and analyzing European and national legislation, the thesis will focus on the powers of the Garante and its functions, how to file a complaint following a violation, how to obtain damages, and when to appeal to the ordinary courts. The importance of data protection and the role of the Guarantor will be highlighted, and what rights each individual has but does not actually know.

L'elaborato riguarda i due binari di tutela che la persona fisica possiede per proteggersi in caso di violazione della privacy, la tutela di fronte al Garante per la protezione dei dati personali e il ricorso al giudice ordinario. Dopo aver approfondito che cosa si intende per privacy e protezione dei dati e analizzato la normativa europea e nazionale, la tesi verterà su i poteri del garante e le sue funzioni, su come presentare un reclamo in seguito ad una violazione, come ottenere un risarcimento danni, quando ricorrere al giudice ordinario. Verrà evidenziata l'importanza della data protection e del ruolo del Garante e quali siano i diritti che ogni soggetto possiede ma che in realtà non conosce.
