Distacco illegittimo e diritto al rifiuto del lavoratore

The thesis addresses the issue of illegitimate detachment and the worker's right to refuse the work illegitimately due. The first part has a general nature and outlines the constituent elements of the detachment. In the absence of these elements the detachment is illegitimate. Subsequently the concept of worker consent to detachment is discussed, which will be irrelevant except in some particular cases. Finally the last part analyzes the worker's right to refuse and the various self-defense tools of which the worker can avail himself to legitimately refuse the detachment contrary to the law (art. 30 Legislative Decree 276/2003).

La tesi affronta il tema del distacco illegittimo e il diritto del lavoratore di rifiutare la prestazione illegittimamente dovuta. La prima parte, di carattere generale, illustra gli elementi costitutivi del distacco in mancanza dei quali esso risulta illegittimo. Successivamente viene trattato il concetto di consenso del lavoratore al distacco che, come verrà spiegato nella tesi, risulterà irrilevante ad eccezione di qualche fattispecie particolare. Infine l'ultima parte analizza il diritto al rifiuto del lavoratore e dei vari strumenti di autotutela dei quali il lavoratore può avvalersi per rifiutare in modo legittimo il distacco contrario alla legge (art. 30 d.lgs. 276/2003).
