INDAGINE SUL COMMERCIO DI ANIMALI ESOTICI: ANALISI DELLA LEGISLAZIONE E DELLE IMPLICAZIONI ETICHE CON UN FOCUS SUL CONTESTO ITALIANO

This thesis delves into the intricate discourse surrounding the ownership of exotic pets, prompting a global reconsideration of regulations. Scientists, researchers, and non-governmental organizations have consistently highlighted critical issues linked to exotic pet ownership, spanning concerns about public health, safety, animal welfare, and biodiversity conservation. The unsustainable wildlife trade, both legal and illegal, emerges as a pivotal factor in population decline and the increased risk of extinction for commercially valuable species. Yet, the clandestine nature of illegal trade and the scarcity of global studies on legal trade contribute to a fragmented understanding of international trade networks. The study aims to provide a comprehensive overview of the challenges associated with keeping exotic animals as pets, shedding light on the scope of the phenomenon. It encompasses exotic mammals, birds and reptiles. Building upon these objectives, the thesis conducts a critical examination of the challenges embedded within the current legal framework, both at the European and Italian levels, pertaining to the ownership of exotic animals as pets. This scrutiny of legal structures serves as a focal point for identifying potential shortcomings, ambiguities, and areas in need of improvement within the regulations governing this intricate issue. Simultaneously, the research recognizes the inherent limitations in fully grasping the reality of the wildlife trade. Through a comprehensive examination of existing literature, the thesis unveils under-represented trade sectors, such as the online marketplace. The investigation is notably centered on the Italian context, where recent political and legislative debates, notably influenced by “LEGISLATIVE DECREE No. 135 of August 5, 2022”, will be meticulously analyzed to discern both positive and negative aspects. The thesis gives significant attention to key stakeholders in the discourse, including veterinarians, pet markets, animal welfare associations, and public perception. Utilizing the 'ethical matrix' as a tool, the study conducts a bottom-up examination of the welfare, dignity, and autonomy of these stakeholders, providing valuable insights to the ongoing debate. In sum, the thesis aspires to not only contribute to academic discourse but also to inform policymakers, practitioners, and the public about the tangible implications of the exotic pet trade. It aims to foster a more informed and evidence-based approach to decision-making in this contentious field.

Questa tesi approfondisce l'intricato discorso che circonda la detenzione di animali esotici, spingendo una riconsiderazione globale delle regolamentazioni. Scienziati, ricercatori e organizzazioni non governative hanno costantemente evidenziato questioni critiche legate al possesso di animali esotici, questioni che abbracciano le preoccupazioni sulla salute pubblica, la sicurezza, il benessere degli animali e la conservazione della biodiversità. L'insostenibile commercio di animali selvatici, sia legale che illegale, emerge come un fattore chiave nel declino della popolazione e nel crescente rischio di estinzione per le specie di valore commerciale. Tuttavia, la natura clandestina del commercio illegale e la scarsità di studi globali sul commercio legale contribuiscono a una comprensione frammentata delle reti commerciali internazionali. Lo studio mira a fornire una panoramica completa delle sfide associate alla custodia di animali esotici come animali domestici, facendo luce sulla portata del fenomeno. Fenomeno che comprende mammiferi, uccelli e rettili. Sulla base di questi obiettivi, la tesi conduce un esame critico delle sfide insite nell'attuale quadro giuridico, sia a livello europeo che italiano. Questo esame delle strutture giuridiche serve come punto focale per individuare potenziali carenze, ambiguità e aree che necessitano di miglioramenti all'interno dei regolamenti che disciplinano questa complessa questione.Allo stesso tempo, la ricerca riconosce i limiti inerenti a cogliere pienamente la realtà del commercio della fauna selvatica. Attraverso un esame completo della letteratura esistente, la tesi rivela settori commerciali sottorappresentati, come il mercato online. L'indagine è incentrata in particolare sul contesto italiano, dove i recenti dibattiti politici e legislativi, influenzati in particolare dal "DECRETO LEGISLATIVO n. 135 del 5 agosto 2022", saranno meticolosamente analizzati per discernere aspetti sia positivi che negativi. La tesi presta un'attenzione significativa alle principali parti interessate nel discorso, compresi i veterinari, i mercati degli animali domestici, le associazioni per il benessere degli animali e la percezione pubblica.
