NUOVE SOGGETTIVITÀ GIURIDICHE E TUTELA DEI DIRITTI DELLA NATURA: PROSPETTIVE COMPARATISTICHE

In this paper the concept of legal subjectivity is treated as an initial theme, starting from the history of the term and all the various facets and evolutions that this legal category has had throughout history. Subsequently, the Italian situation on the topic is addressed with particular reference also to the "animal question". Subsequently, the issue of nature protection is addressed, in particular, how some states at an international level have decided to give legal subjectivity to the elements of nature in order to guarantee greater protection. Finally, this issue of nature protection at an international level is compared with the objectives of the European Union and Italy regarding the protection of nature, the national landscape and the European Union. Finally, the thesis ends with some reflections by scholars and experts on the topic of legal subjectivities, trying to evaluate all the prospects and future opportunities.

In questo elaborato viene trattato come tema iniziale il concetto della soggettività giuridica, partendo proprio dalla storia del termine e tutte le varie sfaccettature ed evoluzioni che questa categoria giuridica ha avuto nel corso della storia, successivamente viene affrontata la situazione italiana sul tema con particolare riferimento anche alla "questione animali". Successivamente viene affrontata la tematica della tutela della natura, in particolare, di come alcuni stati a livello internazionale hanno deciso di dotare di soggettività giuridica gli elementi della natura per potervi garantire una tutela maggiore. Infine questa tematica di protezione della natura a livello internazionale viene posta in comparazione con gli obbiettivi dell'Unione Europea e dell'Italia in merito alla tutela della natura, del paesaggio nazionale e dell'unione europea. L'elaborato infine termina con alcune riflessioni di studiosi ed esperti sul tema delle soggettività giuridiche cercando di valutarne tutte le prospettive e opportunità future.
